Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of Rhinitips (the “App”). By downloading, accessing, or using the App, you agree to these Terms.

If you do not agree, do not use the App.

2. Eligibility

The App is not intended for children under 16. By using the App, you confirm you are at least 16 years old (or have valid consent from a parent/guardian where required by law).

3. The App is informational only (medical disclaimer)

• Not medical advice: The App is for general informational purposes only and does not provide medical advice.
• Not a medical device: The App is not a regulated medical device.
• Consult a professional: For medical advice, contact your doctor or other qualified healthcare professional.
• Emergencies: If you think you may have a medical emergency, call your local emergency number immediately.
• No reliance: You use the App at your own risk.

4. Account registration (optional)

Some features may require an account. You agree to provide accurate information, keep credentials secure, and notify us if your account is compromised. You are responsible for activity under your account.

5. Your content and inputs

You remain responsible for what you submit. You grant us permission to process your inputs as needed to provide App functionality (see our Privacy Policy for details).

6. License to use the App

We grant you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use. You must not copy, modify, reverse engineer, circumvent security, infringe rights, or interfere with the App.

7. Third-party services and data sources

The App relies on third-party services (authentication, hosting, mapping, pollen/air quality data, content). Your use may be subject to their terms. We are not responsible for third-party services.

8. Availability and changes to the App

We may change, suspend, or discontinue any part of the App at any time. We do not guarantee that the App will always be available, uninterrupted, secure, or error-free.

9. Intellectual property

The App and its content (excluding third-party content and your inputs) are owned by us or our licensors. Nothing in these Terms transfers ownership to you.

10. Acceptable use

You agree not to use the App to:

• violate any law or regulation
• harass, abuse, harm, or threaten others
• send malware or attempt unauthorized access
• scrape, bulk download, or systematically extract data
• misuse the App in a way that could cause excessive load or disruption

We may suspend or terminate access if you violate these Terms.

11. Disclaimer of warranties

To the maximum extent permitted by law, the App is provided “as is” and “as available”. We disclaim all warranties. We do not warrant that forecasts will be accurate or that the App will meet your requirements.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages. We will not be liable for harm arising from reliance on App information. Our total liability will not exceed the amount you paid in the 12 months before the claim (or EUR 0 if you did not pay).

13. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of the App or your violation of these Terms.

14. Termination

You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the App or users. Termination does not affect surviving provisions.

15. Privacy

Our processing of personal data is described in our Privacy Policy.

16. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date and may provide notice in the App. If you continue to use the App after changes, you agree to the updated Terms.

17. Governing law and jurisdiction

These Terms are governed by the laws of Belgium, EU, excluding conflict of law rules. Courts in Belgium, EU will have jurisdiction. Nothing limits consumer protection rights under mandatory laws in your country of residence in the EU/EEA.

18. Severability

If any part of these Terms is found unenforceable, the remaining parts remain in full force and effect.
